Contract and Terms

Information & Terms: A non-refundable deposit and an authorized signature on your proposal will reserve your activities and date. The balance is due on or before the date of the event prior to set-up. We reserve the right to set appropriate rules of conduct and age/weight/time limits in order to best facilitate your event and maintain a safe environment. Cancellation and Rain Policy: This contract, after signing, is a legal and binding contract. To cancel or reschedule, sufficient notice must be given – at least 2 weeks prior to the start of your event. Cancellation of the event with less than ‘the morning of delivery’ notice forfeits the entire deposit. Cancellation after set-up has begun forfeits any refund. Postponement of the event may entitle you to use all or part of your deposit towards a timely rescheduled event at our availability. Any rescheduled event is subject to the availability of activities at the time of notification of postponement. Care of Rental Equipment: Customer will be responsible for any and all damage to any of the Rental Equipment not caused by ordinary wear and tear. “Ordinary wear and tear” will mean only the normal deterioration of the rental equipment caused by ordinary, reasonable, and proper use of the rental equipment. Customer shall be liable to Jumping Jacks for any and all damage, which is not “ordinary wear and tear”, including but not limited to the application of paint, tape, permanent marker, “Silly String” or the unauthorized application of water to any devices not specifically authorized by Jumping Jacks Event Rentals LLC. Damage to units will result in a Repair Fee ranging from a minimum of $250 up to the cost of replacing the unit damaged. Equipment must be returned to Jumping Jacks in the same clean condition it was received. Equipment that is returned and must be reconditioned will result in a Reconditioning Fee of $50 charged for each hour required to restore Equipment. Overnight Reservations: Lessee will deflate the inflatable during any duration in which it can not be monitored or winds are over manufacturer requirements (about 15mph) by unplugging the cord from the wall outlet. When you are ready to use the inflatable, simply plug it back in and give it approximately 5 minutes to inflate. Lessee will be responsible for any damages including theft, cuts, tears, damages caused by animals, burns, or any other intentional or unintentional damages unless the appropriate damage waiver is purchased. Lessee understands and acknowledges that the blower is to be removed from the inflatable device and locked up in a secure location overnight. Hold Harmless Provision: Lessee recognizes and understands that the use of Lessor equipment may involve inherently dangerous activities. Consequently, lessee agrees to indemnify and hold lessor harmless from any and all claims, actions, suits, proceeding costs, expenses, damages, and liabilities, including reasonable attorney’s fees arising by reason of injury, damage, or death to persons or property, in connection with or resulting from the use of said equipment including, but not limited to the delivery, possession, use, operation, or return of the equipment. Lessee hereby releases and holds harmless lessor from injuries or damages incurred as a result of the use of said equipment unless the lessor is operating the equipment and is deemed by a court of law to be negligent in its actions. Lessor cannot under any circumstances be held liable for injuries as a result of acts of God, nature, or other conditions beyond its control or knowledge. Lessee also agrees to indemnify and hold harmless lessor from any loss, damage, theft, or destruction of the equipment during the term of this contract and any extension thereof. Merger Clause: This signed Agreement in conjunction with the signed Instruction Manual and Reservation Form contains the entire agreement between the Lessor and the Lessee. No amendment, whether from previous or subsequent negotiations between the Lessee and the Lessor, shall be valid or enforceable unless in writing and signed by all parties to this contract. The invalidity or unenforceability of any particular provision of this Agreement shall not affect the other provisions hereof. Item Specific Details: Lessor (Jumping Jacks Event Rentals LLC) will: 1. Provide the necessary staff to facilitate your event and power cords to reach up to 75ft. 2. Deliver, set-up, tear-down, and operate all activities with/without volunteer staff. 3. Carry a liability insurance policy covering our services & equipment. Lessee (that’s you)  will: 1. Provide ___ 110volt/15amp electric circuits. 2. Provide necessary hose length for any water inflatable rented. 3. Provide any required entrance and parking passes. 4. Provide a minimum of ___ adult volunteer(s) to operate the activities.
